Section 3.Amendment to Section 30-23, Monthly sewer rates, Subsection (i).


Section 30- 23(i) "Leakage Adjustment", of the Code of Ordinances of the City of DeLand is hereby repealed and replaced with a new subsection (i), to read, in full, as follows:

  • Consumer Credits Available Upon Application. Sanitary sewer customers may apply for the credits set forth below. The final discretion to make such adjustments shall be vested in the City Staff member designated by the City Manager from time to time.
  1.  A customer may apply for a credit on the sewer portion of a utility bill for filling a swimming pool for a necessary purpose. The customer must provide a bona fide letter from a swimming pool company proving how much water was necessary and used to fill the swimming pool.
  2. A customer may apply for a one-time credit on the sewer portion of a utility bill if the customer proves that a water hose was accidentally left running, or a water faucet was accidentally left running. The customer must provide proof of the accidental act causing the flow and that all reasonable steps were taken to prevent the accident and mitigate its effect.
  3. A customer may apply for a one-time credit for each 12 months on the sewer portion of a utility bill if the customer proves that flow occurred due to a toilet leak, washing machine leak, or similar occurrence. The customer must provide proof of the inadvertent action causing the flow and that all reasonable steps were taken to prevent the accident and mitigate its effect.
  • Leakage adjustment. When there is a leak in the water line outside the building, the customer can request a credit for water and sewer volume charges only. A maximum leak credit, if applicable, of two months can be provided on an account once in any twelve (12) month period based on the average consumption for the previous six (6) months. The leak credit can be provided once the customer has provided documentation of a current repair and the City has verified that the leak has been repaired. No credit will be given for leaks inside the building or for any leaks that have not been repaired.
  • Once a leak has been identified by the City or the customer has notified the City of a leak, customer shall have two months to repair the leak and request credit be given, if applicable. Beyond that time period, no leak credits shall be provided.
