Sec. 12-8. - Permit required for open burning in residential areas.
(a)On the day the open burning is to be conducted, any person or agency requesting an open burning permit should come to the Administrative Offices of Station 81 located at 201 West Howry Avenue, DeLand, Florida.(b)The open burning guidelines as set forth by the City of DeLand Fire Department's burn permit and the Code of Ordinances for the City of DeLand must be adhered to or the fire must be extinguished.

Sec. 12-9. - Fees and penalties.
(a)Any person violating any of the provisions of this section shall be liable for all damages caused by such violation, which damages shall be recoverable in any court of competent jurisdiction. The civil liability shall obtain whether there be criminal prosecution and conviction or not. The city commission may by resolution establish fines for violations of any of the provisions of this section including, but not limited to warnings, the burning site is left unattended, the fire is larger than the requirement, unauthorized burns, burning site is not extinguished by stated time, and referrals to Special Magistrate of City of DeLand Code Enforcement. The liability for the costs of suppression shall extend to the person, firm, or corporation causing, directing, or permitting the activity as well as to the actual violator.(b)When standby fire protection or rescue service is required or requested for any of the above-referenced violations, the following charges shall apply:(1)Fire apparatus—Minimum charge of $150.00 with additional charge of $150.00 per hour per apparatus.(2)Personnel cost based on the actual cost of the wages and benefits of the personnel assigned. The fee above includes apparatus, personnel, and administrative expense.

Sec. 12-10. - Declaration of burn ban.
When drought situations occur constituting atmospheric conditions and local circumstances such that outdoor fires, if not properly contained and controlled, could lead to wild fires that would pose a severe threat to residents and visitors of the City of DeLand, then under the direction of the fire chief for the City of DeLand, all outdoor burning, unless authorized by the Florida Division of Forestry, including, but not limited to, the burning of yard trash, household paper products, bonfires, campfires, warming fires, and cooking fires is hereby prohibited. Outdoor cooking done within a contained gas or charcoal grill (excluding a fire pit) is the only exception.

Sec. 12-11. - Violation of burn ban.
A violation section 12-10 shall constitute a misdemeanor punishable by a fine not to exceed $500.00 or imprisonment for a term not to exceed 60 days, or both such fine and imprisonment
